Not all Wills need to be complex. Whether a complex or testamentary trust arrangement is needed comes down to personal circumstances and wishes and intentions.

A person may be entitled to challenge a Will. Examples of where a challenge can occur (or arise) are:

  • Where there are questions about the mental capacity of the person that made the Will
  • Where there is dissatisfaction about the contents of the Will (provision under the will being made)
  • Where there is a belief that the person that made the Will was under the influence of (duress) another.
